1. Overview
These Terms and Conditions ("Terms") govern your use of StetOps ("we," "us," or "our"), accessible at stetops.com. By creating an account or purchasing any service, you agree to these Terms. If you're agreeing on behalf of a company, you confirm you have the authority to do so.
2. Services
StetOps provides competitive positioning intelligence services, including:
- Forensic Reports: One-time, in-depth analysis of competitor positioning across public-facing surfaces.
- Continuous Monitoring: Ongoing, scheduled monitoring and reporting of positioning changes over time.
Our service involves crawling publicly available web pages, reviewing public content, and synthesizing findings into structured reports.
3. Accounts and Access
You must create an account to access our services. Authentication is handled via Better Auth. Your account credentials are stored securely in our database, hosted on Microsoft Azure.
You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at [support@stetops.com] if you suspect unauthorized access.
4. Payments and Billing
All payments are processed securely through Stripe. We do not store your payment card details or any sensitive financial data on our systems. By making a purchase, you also agree to Stripe's terms of service.
- Forensic reports are billed as one-time purchases.
- Continuous monitoring subscriptions are billed on a recurring basis as agreed at time of purchase.
- All fees are non-refundable unless otherwise stated or required by applicable law.
If a payment fails, we reserve the right to suspend access until the balance is settled.
5. Data We Collect and Retain
Account Data: Your name, email address, and authentication credentials, stored securely on Azure.
Report Data: Reports we generate on your behalf are retained indefinitely on our systems unless you:
- Request deletion of specific reports, or
- Delete your account.
Upon account deletion, all associated data and reports will be permanently removed within 30 days.
Usage Data: We may collect standard usage and analytics data to improve the service.
We do not sell your data to third parties.
6. Your Data and Confidentiality
Reports generated for your account are private to your organization. We will not share your reports or the specific competitive intelligence contained within them with any other customer or third party, except as required by law.
You retain ownership of any data, materials, or inputs you provide to us. We retain ownership of the report format, analytical frameworks, and delivery infrastructure.
7. Crawling and Public Content
Our service involves automated crawling of publicly accessible websites. We only collect content that is publicly available without authentication. We do not circumvent paywalls, access controls, or robots.txt restrictions.
You acknowledge that the accuracy of reports depends on the availability and accuracy of public information. We are not responsible for errors or omissions in publicly available source material.
8. Acceptable Use
You agree not to:
- Use StetOps for any unlawful purpose.
- Attempt to reverse-engineer, scrape, or reproduce our methodologies or platform.
- Resell or redistribute reports without written consent.
- Use the service to target individuals rather than organizations.
We reserve the right to suspend or terminate accounts that violate these Terms.
9. Intellectual Property
All platform software, design, frameworks, and processes are owned by StetOps. Reports generated are licensed to you for internal business use only. You may share reports internally with your team and present findings to your organization, but may not publish or resell them without our written permission.
10. Disclaimer of Warranties
StetOps is provided "as is." We make no warranties, express or implied, that the service will be uninterrupted, error-free, or that reports will be free from inaccuracies. Competitive intelligence is inherently based on publicly available information, which may be incomplete or change rapidly.
11. Limitation of Liability
To the maximum extent permitted by law, StetOps shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 90 days preceding the claim.
12. Termination
Either party may terminate the agreement with 30 days' written notice. We may terminate immediately for material breach of these Terms. Upon termination, your access to the platform will cease and, upon your request, your data will be deleted.
13. Changes to These Terms
We may update these Terms from time to time. We'll notify you by email or in-app notice when material changes occur. Continued use of the service after notice constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of [Jurisdiction — e.g., the State of Delaware, USA]. Any disputes shall be resolved in the courts of that jurisdiction.
